Dutch Cloud Community has major concerns about recent legal assistance to the Trump administration – Dutchcloudcommunity

Position of Dutch Cloud Community regarding the seizure of the A/I server in Amsterdam ยท October 15, 2026

The fact that an American decision affects an Italian organization is already far-reaching. However, the fact that the Dutch police subsequently cooperate with an American request, without public statements indicating that a Dutch judge or the Public Prosecution Service has reviewed that request, is a situation we consider unacceptable in a democratic constitutional state.

A request for legal assistance must describe the facts and the legal suspicion. As far as is publicly known, this is based on an administrative decision and not a ruling by a criminal court. This makes it all the more important that an independent Dutch review takes place before third-party data crosses the border.

We request clarification from the parties concerned regarding exactly what happened here and what precedent this sets.

The precedent is concerning. If an American request is executed without visible scrutiny, a Dutch data center no longer serves as a safeguard against the consequences of foreign political decisions. The data center party itself also finds itself in a difficult position, as it cannot assess whether a request meets the requirements.

Finally, the case shows what an accusation without a judicial ruling means in practice: the organization collapsed as a precaution, even before a judge had reviewed it.
